Sudbury company fined for fatality

A Sudbury company has been fined in connection with a fatality in the Elliot Lake area two years ago.

Ministry of Labour spokesperson Janet Deline says Teranorth Construction & Engineering of Sudbury pleaded guilty in court on Monday and was fined $125,000 as well as a 25-per-cent victim fine surcharge as required by the Provincial Offences Act.

She says testimony provided by another motorist observed the driver of a water truck jump out of it when it was weaving on a downhill slope on Highway 639 back on October 13th, 2017.

The motorist also saw the truck roll backwards and flip on its side on the roadway just north of Elliot Lake.

A Ministry of Labour engineer also testified an inspection of the braking assist system showed that the electric back-up pump had failed due to corrosion.

The court also found the company had failed to provide instructions to the worker in the operation of the vehicle on hilly terrain as well as not having tested the braking system as part of the daily vehicle inspection.
